Terms of Service

1. Scope and Provider

These Terms of Service govern the use of HeadCom, an online competitive gaming platform operated by HeadCom — Daniel Schmidt, c/o Online-Impressum 11035, Europaring 90, 53757 Sankt Augustin, Germany. HeadCom provides player profiles, matchmaking, competitive matches, rankings, clans, communication features and related services.

2. Acceptance and Contract

Use of HeadCom requires acceptance of these Terms where a contractual relationship with HeadCom is established. The Terms are made available to the user before or at the time acceptance is required. The HeadCom Rules form part of the contractual framework for competitive use of the platform and supplement these Terms for competitive activities. Mandatory statutory rights remain unaffected.

3. Eligibility and Accounts

HeadCom is exclusively available to persons aged 18 or older. By using HeadCom, you confirm that you are at least 18 years old. Persons under the age of 18 may not create or use a HeadCom account. HeadCom accounts are connected to a user's Steam identity. Users may only operate their own account. Account sharing, selling, buying and transferring accounts are prohibited. Users are responsible for activity performed through their account and must keep their account access secure. Where HeadCom requires information for verification or security purposes, users must provide accurate information.

4. Verification

HeadCom may use verification and security measures to protect the platform and competitive integrity. Current HeadCom verification requires a verified mobile phone number and 50 completed HeadCom matches. Verification requirements may be changed prospectively where necessary for security, abuse prevention or platform integrity.

5. Competitive Matches and Rankings

HeadCom provides competitive matches and an ELO-based ranking system. Matchmaking, map vetoes, match acceptance, match results, ELO calculations and related technical processes are operated according to the current HeadCom Rules and platform implementation. Players must participate honestly and must not manipulate matches, rankings, statistics or matchmaking.

6. Match Results, ELO and Historical Records

Match results and rating changes determined by the HeadCom system are generally final unless HeadCom officially corrects or overturns them. HeadCom may correct technical errors, exploit-related results, fraudulent results or other results affected by violations. Historical competitive records may remain available after account deletion where necessary for the integrity of rankings, statistics, match history, security, abuse prevention or legal purposes.

7. Rules and Fair Play

The HeadCom Rules contain the detailed competitive and conduct requirements. In particular, cheating, unauthorized assistance, exploitation of vulnerabilities, match manipulation, wintrading, ELO boosting, harassment, threats, discriminatory content, spam, malicious links and attempts to bypass HeadCom security measures are prohibited.

8. Communication and User Content

Users may use HeadCom communication features such as general chat, match chat, private messages, guestbook features and other social functions where available. Users are responsible for content they submit and must not use HeadCom to distribute unlawful, threatening, abusive, discriminatory, fraudulent, malicious or otherwise prohibited content. Users must respect the rights of other persons and must not use HeadCom for unauthorized advertising or malicious links.

9. Reports and Moderation

HeadCom may receive and investigate reports concerning cheating, abuse, harassment, match manipulation, technical exploitation, inappropriate content and other violations. HeadCom may review relevant platform, match and communication evidence where necessary for moderation. Depending on the circumstances, HeadCom may issue warnings, communication restrictions, Queue Bans, match-related penalties, temporary bans or permanent bans.

10. Appeals

Where a punishment is eligible for appeal, users may use the available HeadCom appeal process. Appeals should contain truthful and relevant information. An appeal does not automatically suspend a punishment. HeadCom may uphold, reduce, modify or revoke a punishment after review.

11. Account Restrictions and Termination

HeadCom may restrict, suspend or terminate access where this is necessary because of serious or repeated rule violations, cheating, abuse, security risks, unlawful conduct, ban evasion, manipulation of the platform or other substantial breaches of these Terms or the HeadCom Rules. Where appropriate and technically possible, HeadCom may take proportionate measures based on the circumstances of the violation.

12. Account Deletion

Users may permanently delete their HeadCom account through the available account deletion function. Account deletion is irreversible. Deletion does not require HeadCom to erase information that it is legally required or otherwise legally permitted to retain. Historical match records, competitive statistics, moderation records and other records may remain where continued retention is necessary for legitimate operational, security, abuse-prevention or legal purposes.

13. Availability and Technical Changes

HeadCom is provided subject to technical availability. Maintenance, updates, security measures, development work, infrastructure failures and other circumstances may temporarily restrict or interrupt individual features or the platform. HeadCom does not guarantee uninterrupted availability or that every feature will remain permanently available.

14. Security and Misuse

Users must not attack, overload, circumvent, reverse engineer for abusive purposes, or otherwise interfere with HeadCom infrastructure or security systems. Attempts to gain unauthorized access, bypass restrictions, manipulate requests, exploit vulnerabilities or interfere with game-server infrastructure may result in immediate restrictions and further action.

15. Third-Party Services

Certain HeadCom functions depend on third-party services, including Steam and technical infrastructure providers. Third-party services are subject to their own terms and privacy information. HeadCom is not responsible for interruptions or changes originating solely from third-party services, without limiting any mandatory rights of users under applicable law.

16. User Rights and Mandatory Law

Nothing in these Terms excludes or restricts rights that cannot legally be excluded or restricted. Mandatory consumer, data-protection and other statutory rights remain unaffected.

17. Liability

HeadCom is liable in accordance with applicable law. Nothing in these Terms excludes liability for intent, gross negligence, injury to life, body or health, or other liability that cannot legally be excluded or limited. For other cases, any limitation of liability applies only to the extent legally permissible.

18. Changes to These Terms

HeadCom may amend these Terms where this is necessary to reflect changes to the service, applicable legal requirements, security requirements, technical developments or platform functionality. Where legally required, material changes will be communicated to users in an appropriate manner before they become applicable and, where required, will require separate acceptance. Changes will not retroactively remove rights that have already arisen unless this is permitted by applicable law. Continued use of HeadCom does not by itself constitute acceptance of materially changed Terms where separate acceptance is legally required.

19. Governing Law

German law applies to the contractual relationship to the extent legally permissible. Mandatory consumer protection provisions of the country in which a consumer has their habitual residence remain unaffected.
